π What Is a Patent?
A patent is an exclusive right granted for an invention β a product or a process that offers a new technical solution or a novel method of doing something. Patent protection prevents others from commercially making, using, selling, or importing your invention without your consent.
To obtain a patent in Cyprus, you must disclose technical information about your invention through a formal Cyprus patent application.
Once granted, a patent provides protection for 20 years from the date of filing. This protection may be extended to up to:
- 25 years for pharmaceutical or plant protection products via a Supplementary Protection Certificate (SPC)
- 25 years and 6 months for pediatric medicinal products
π Are You Eligible to Register a Patent in Cyprus?
The Cyprus Patents Law of 1998 (Law 16(I)/1998) governs the registration of patents in the Republic of Cyprus. Not every invention is patentable. To be eligible for a patent in Cyprus, your invention must meet the following criteria:
β Patentable Subject Matter
The invention must be technical in nature. The following are excluded from patent protection under Cypriot law:
- Discoveries, scientific theories, and mathematical methods
- Aesthetic creations
- Rules or methods for intellectual or business activities, games, or software as such
- Presentations of information
β Public Order & Morality
No patent is granted for inventions whose exploitation would contravene public order or accepted moral standards β even if prohibited by law.
β Novelty
Your invention must be new and not part of the prior art β any information made publicly available before the application or priority date.
β Inventive Step
The invention must not be obvious to a professional in the relevant field based on existing knowledge or prior art.
β Industrial Applicability
The invention must be capable of being manufactured or used in any kind of industry β broadly interpreted to include biotechnology, agriculture, aquaculture, and services.
π How to Apply for a Patent in Cyprus
Once you confirm that your invention meets the criteria for protection, you can file a patent application in Cyprus with the Department of the Registrar of Companies and Intellectual Property.
Required Documents (Form P.9)
Submit your application by hand or post, along with the following documents:
- Invention description
- Patent claims
- Abstract/summary
- Technical drawings (if applicable)
- Power of Attorney (Form P.8)
- Certified translation into English, German, or French (with affidavit)
Official filing fee: β¬100
π Patent Eligibility Search β Research Report Requirement
After your application passes preliminary checks, you are required to obtain a research report from a recognized International Patent Examination Office (e.g., EPO). This must be submitted within 16 months of the filing (or priority) date.
If using the European Patent Office (EPO), the following must be submitted:
- Official translation of all documents into English, French, or German
- Translation by affidavit or by a sworn translator registered in Cyprus
- Fee: β¬2488 payable to the Registrarβs fund
Once the research report is received and filed, your application proceeds to the next stage.
π Certificate of Grant β Final Step
Upon confirmation of patentability and payment of the final fee of β¬130, the Certificate of Grant of Patent is issued and published in the Cyprus Official Gazette.
